Terms and Conditions of Sale
1. Preamble
1.1 These General Terms and Conditions (the “Terms and Conditions”) apply to any purchase made by a Customer from Human And Science on its website accessible at https://huandsci.com (hereinafter “the Site”).
Human And Science is a simplified joint‑stock company (SAS), whose registered office is located at 55 rue de Rome, 75008 Paris, with a share capital of €50,000, registered with the Paris Trade and Companies Register under number 943 973 511.
1.2 Use of the Site itself is subject to our Website Use Conditions.
2. Acceptance / Opposability of the Terms and Conditions
2.1 The Customer undertakes to read carefully the present Terms and Conditions and to expressly accept them before proceeding to pay for an order placed on the Site.
2.2 The present Terms and Conditions are referenced by a link accessible at the bottom of each page of the Site and must be consulted before placing an order. The Customer is invited to read them attentively, download, print them and keep a copy.
2.3 To validate the Order the Customer must tick the box “I accept the terms and conditions of sale” after having read the Terms and Conditions. By ticking this box and validating the order, the Customer acknowledges having read, understood and accepted the Terms and Conditions without reservation.
2.4 The present Terms and Conditions prevail over any other document not expressly accepted by Human And Science.
2.5 Human And Science reserves the right to modify at any time and without prior notice its Terms and Conditions. In such case, the modifications will apply to orders placed by the Customer after the modified Terms and Conditions have been posted on the Site. The Customer is therefore invited to consult them before each order and/or use of the Site.
3. Orders
3.1 To be able to place an order on the Site, the Customer must have an account on the Site. To this end, the Customer shall create an identifier and choose a password.
3.2 The Customer may place an order to purchase a product offered for sale on the Site by following the on‑screen prompts after clicking on the product of interest. The Customer may check and correct any data entry errors in the order up to the moment of order validation.
3.3 After submitting the order, the Customer will receive an acknowledgment of receipt by e‑mail. This message constitutes an acknowledgment of receipt of the order, and not its acceptance.
3.4 Acceptance of the order and the formation of the contract binding Human And Science to the Customer shall take effect upon sending an e‑mail confirming that the ordered products will be shipped.
3.5 The Customer may check the status of an order in progress at any time by searching for the relevant order after logging into the “Your Account” section of the Site, entering the username and password created during registration on the Site.
4. Prices and Payment Terms
4.1 The price of the products shall be the price indicated on the Site, except in case of manifest error. Product prices include VAT at the prevailing rate. Prices shown on the Site exclude delivery charges, which are indicated separately on the Site.
4.2 Human And Science may modify its prices at any time. Accepted orders will be invoiced at the rates in force at the time of acceptance by Human And Science.
4.3 Acceptance of an order is conditional upon payment of the total amount thereof. Payment may be made by means of the major credit/debit cards, by filling in the appropriate information on the validation page.
4.4 The Site contains a large number of products and it is always possible that, despite all efforts of Human And Science, some products shown on the Site may be incorrectly priced. Human And Science normally verifies prices within its shipping procedures so that, when the correct price of a product is lower than the price indicated, the Customer is charged the correct price. Conversely, if the correct price of a product is higher than the price shown on the Site, Human And Science reserves the right to reject or cancel the order and will inform the Customer accordingly.
4.5 By using a credit/debit card to pay for the order, the Customer guarantees and confirms that the card used is his/her own, or, if it is not, that he/she is authorised to use it. All credit/debit card transactions are subject to validation checks and to the authorisation of the card‑issuing bank. If the card‑issuing bank refuses to authorise payment, the order will not be accepted; Human And Science is not obliged to inform the Customer of the reasons for the refusal and disclaims any liability for non‑delivery of the ordered products. Human And Science shall not be liable for any fees charged by the card‑issuing bank or the bank arising from the processing of the credit/debit card payment for the order.
4.6 Human And Science recommends that the Customer does not communicate credit/debit card details by e‑mail or instant messaging, not even to Human And Science. Human And Science cannot be held responsible for any loss that could result from transmitting such information to its services via the Internet, e‑mail or instant messaging. Such loss shall be the sole responsibility of the Customer.
5. Transfer of Ownership
5.1 Human And Science remains the owner of the delivered product until full payment has been made by the Customer.
5.2 The foregoing provisions do not prevent the transfer to the Customer, at the moment when the Customer or a third party designated by him/her takes physical possession of the product, of the risks of loss or damage to the product subject to the reservation of title, as well as of the risks of damage that could ensue.
6. Delivery
6.1 Delivery dates indicated on the Site, in commercial documents or by e‑mail are provided for information only. They do not constitute a firm commitment on the part of Human And Science, nor a guarantee of delivery on a precise date.
6.2 Delivery charges will be added to the total amount payable after the Customer selects the desired delivery service from the options available.
6.3 Delivery is made to the address specified in the order. The Customer may not change the shipping address once the order has been placed.
7. Right of Withdrawal (for Consumer Customers only)
7.1 The Consumer Customer has, in principle, the right to withdraw by returning or restoring the Product to Human And Science, without giving any reason, within the limits laid down by law.
To this end, the Product must be returned or restored no later than fourteen (14) days following the communication of the decision to withdraw for France customer.
7.2 The withdrawal period expires fourteen (14) days after the day on which the French Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Product.
If the French Customer has ordered several products under a single order giving rise to multiple deliveries, the withdrawal period expires fourteen (14) days after the day on which the French Customer, or a third party other than the carrier and designated by the French Customer, takes physical possession of the last Product.
7.3 The right of withdrawal may be exercised by sending the withdrawal form available following these Terms and Conditions and on the link General Terms and Conditions, or on any other support notified to Human And Science without ambiguity expressing the Customer’s wish to withdraw while indicating the order number concerned:

To respect the withdrawal period, the Customer must transmit the communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
An acknowledgment of receipt will be sent to the Customer by Human And Science. This acknowledgment will specify the procedures to be followed by the Customer for returning the Product.
7.4 In the event of withdrawal by the Customer, Human And Science undertakes to refund the total amount paid, including delivery charges, without undue delay and, at the latest, within fourteen (14) days from the date on which it is informed of the French Customer’s decision to withdraw (Article L. 221‑24 of the French Consumer Code).
Unless it offers to collect the products itself, Human And Science may defer the refund until recovery of the products or until the Customer has provided proof of shipment of the products, the date retained being the earlier of these two events.
Human And Science will effect the refund using the same means of payment as used by the Customer for the initial transaction, unless the French Customer expressly agrees to another means of payment and provided that the refund does not incur any cost to the French Customer.
7.5 The French Customer must, at the latest fourteen (14) days after communicating the decision to withdraw, return the Product to Human And Science at the following address: Human And Science, 55 Rue de Rome, 75008 Paris.
The Products must be returned:
in their original packaging
in perfect condition
if applicable, accessories must also be returned in perfect condition.
If the return transport is not organised by Human And Science, the return transport of the Products is carried out under the Customer’s responsibility; consequently, any damage suffered by a returned Product defeats the right of withdrawal.
We advise the Customer to use a tracking number to be able to confirm proper delivery of the return.
We also advise the Customer to indicate the order number and name/first name inside the return parcel to facilitate return management.
7.6 The Customer shall bear the direct costs of returning the Product, except where Human And Science assumes those costs.
7.7 The Customer’s liability is limited to the depreciation of the Product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product. In other words, the Customer may inspect the Product, but liability may be incurred if the Customer carries out handling other than that which is necessary.
Any finding of deterioration of the returned Products will preclude the Customer from obtaining a refund and the concerned Products will not be taken back by Human And Science. The parcel will then be returned to the Customer at the Customer’s expense.
7.8 The Customer is informed that he/she does not have a right of withdrawal, except in the case of defect or non‑conformity, for:
Downloads of electronic software when the download has commenced with the Customer’s express and prior consent and after acknowledgement by the Customer that he/she loses the right of withdrawal.
Services, once they have been fully performed if execution commenced with the Customer’s express prior consent and after acknowledgement that the right of withdrawal is lost once the services have been fully performed. If the services have not been fully performed and the Customer has requested that execution commence within 14 days following the date of conclusion of the service contract, a sum proportional to the services rendered will be charged until the moment the Customer informs Human And Science of the intention to cancel the service contract.

8. Warranties
8.1 The products you purchase are subject to the limited warranty conditions and exclusions in force at the time of shipment, as displayed on the Site or in the product packaging.
8.2 These limited warranty conditions do not affect legal rights and are added to the consumer rights provided for by EU law or French law.
Thus the Consumer Customer benefits from the legal guarantee of conformity (Articles L. 217‑3 to L. 217‑20 of the Consumer Code) and from the legal guarantee relating to defects of the thing sold (Articles 1641 to 1648 of the Civil Code).
Legal guarantee of conformity
The Customer has a period of two years from the delivery of the goods to obtain implementation of the legal guarantee of conformity in case of appearance of a lack of conformity. During this period, the Customer need only establish the existence of the lack of conformity, not the date of its appearance.
The legal guarantee of conformity entails an obligation for the professional, where appropriate, to provide all necessary updates to maintain conformity of the goods.
The legal guarantee of conformity gives the Customer the right to repair or replacement of the goods within thirty days following the request, free of charge and without major inconvenience for the Customer.
If the goods are repaired under the legal guarantee of conformity, the Customer benefits from an extension of six months of the initial guarantee.
If the Customer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The Customer may obtain a reduction of the purchase price by retaining the goods or terminate the contract by obtaining full refund against return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° Repair or replacement of the goods occurs after a period of thirty days;
3° Repair or replacement of the goods causes major inconvenience for the consumer, notably when the consumer definitely bears the costs of recovery or removal of the non‑conforming goods, or bears the installation costs of the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The Customer also has the right to a reduction of the purchase price or to resolution of the contract when the lack of conformity is so serious as to justify immediate price reduction or contract resolution. The Customer is then not required to request repair or replacement beforehand.
The Customer does not have the right to resolve the sale if the lack of conformity is minor.
Any period of immobilisation of the goods for repair or replacement suspends the guarantee that would otherwise run until delivery of the goods restored to working order.
The rights mentioned above result from the application of Articles L. 217‑1 to L. 217‑32 of the Consumer Code.
Legal guarantee against hidden defects
The Customer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the Customer to a price reduction if the goods are kept, or to full reimbursement against return of the goods.

8.4 Warranties will be excluded if it is demonstrated that the qualities of the products have been altered by the Customer or by improper use by the Customer, or if the Customer has not followed the recommendations given by Human And Science.
9. Product Information
9.1 Human And Science undertakes to present clearly, legibly and understandably the essential characteristics of the products and the mandatory information that the Customer must receive under French legislation, and to verify its accuracy.
These characteristics and information appear on the product sheets available on the Site.
These sheets notably contain the description, the mode of use and the price of the Product.
The Customer undertakes to read carefully this information before placing an order on the Site.
Human And Science takes all necessary measures to display as precisely as possible the colours and other details of its products on the images appearing on the Site. Nevertheless, colours and details shown on the screen depend on the Customer’s monitor; consequently, Human And Science cannot guarantee that the colours or details displayed on the monitor reflect the colour or details of the Product that the Customer will receive.
9.2 Any information relating to the size of the products shown on the Site is provided for information only. If the Customer is unsure about the size of a product, Human And Science invites the Customer to visit www.huandsci.com/notices
10. Liability
10.1 Human And Science is not liable (i) for losses that have not been caused by its breach, or (ii) for any commercial loss (including loss of profits, revenue, contracts, anticipated savings, data, clientele or unnecessary expenses), or (iii) for any indirect or consequential loss that could not have been foreseen by the Customer and Human And Science when the contract for the sale of the products was concluded.
10.2 Human And Science shall not be held responsible for any delay or failure to perform its obligations under these terms if the delay or failure arises from a cause beyond its reasonable control. This provision does not affect the Customer’s right to receive the products within a reasonable time. Thus, if delivery does not occur within a reasonable time and such delay cannot be considered acceptable in view of the circumstances, the Customer may cancel the order. In that case, no amount will be charged to the Customer.
11. Force Majeure
Human And Science’s liability may not be invoked if non‑performance or delay in the performance of any of its obligations set out in these Terms and Conditions results from a case of force majeure.
Force majeure in contract law occurs when an event beyond the control of the debtor, which could not reasonably have been foreseen at the time of entering into the contract and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing its obligation.
If the impediment is temporary, performance of the operation is suspended unless the resulting delay would justify termination of the contract. If the impediment is definitive, the contract is terminated ipso jure and the parties are released from their obligations under the conditions set forth in Articles 1351 and 1351‑1 of the Civil Code.
In the event of occurrence of any of the aforementioned events, Human And Science will endeavour to inform the Customer as soon as possible.
12. Processing of Personal Data
12.1 Every consumer has the possibility to register free of charge on the telephone solicitation opposition list BLOCTEL: https://www.bloctel.gouv.fr/.
12.2 Human And Science collects on the Site personal data concerning its Customers in the context of managing information requests, managing and monitoring accounts and contracts, managing orders and deliveries of products, managing payments, ensuring proper functioning and continuous improvement of the Site, managing requests for rights under the GDPR, and, if the Customer has expressly opted for this option, sending newsletters and commercial offers, unless the Customer no longer wishes to receive such communications from Human And Science.
To this end, the Customer is invited to consult the Human And Science Privacy Policy, which will provide further information on the protection of personal data, the processing carried out via the Site and the procedures for exercising rights.
13. Environmental Provisions – WEEE Take‑Back
In accordance with Articles L.541‑10 and R.541‑163 of the Environmental Code, Human And Science, as a producer under the electrical and electronic equipment waste (WEEE) stream, is registered with ADEME.
Accordingly, an eco‑participation is included in the sale price of the relevant products, intended to finance the collection and treatment of end‑of‑life equipment. Its amount is displayed visibly at the time of purchase.
The Customer is also informed that he/she may deposit WEEE in approved collection points listed on the website of the partner eco‑organisation (www.ecosystem.eco).

15. Export Controls
This contract is subject to the applicable legislation on export controls. The Customer undertakes not to export a product purchased on the Site to another country or region if export‑control laws prohibit it. If the Customer intends to export a product to another country or region, he/she must obtain beforehand the export licences required by law (or any other governmental authorisation).
16. Non‑Waiver
The fact that Human And Science does not invoke a breach by the Customer of any of the obligations set out in these Terms and Conditions shall not be construed as a waiver of that obligation, whether in respect of that breach or any subsequent breach.
No waiver by Human And Science shall be implied and may not, in particular, result from the acceptance of a payment. Such waiver shall result only from an express written waiver signed by a duly authorised representative of Human And Science.
No waiver of a right extends or affects another right, and such waiver does not extend either to any subsequent similar or different breach.
The 1980 United Nations Convention on Contracts for the International Sale of Goods does not apply.
17. Validity
If any provision of these Terms and Conditions is found to be inapplicable under the law, the remaining provisions shall remain unaffected and in full force.
Any amendment to legislation or regulation in force, or any decision of a competent court invalidating one or more clauses of these Terms and Conditions shall not affect the validity of the Terms and Conditions. Such amendment or decision does not in any way authorise Customers to disregard the Terms and Conditions.
18. Dispute Settlement
18.1 Applicable law and prior amicable settlement attempt
Any dispute relating to the conclusion, interpretation, performance or termination of a contract subject to these T&Cs is governed by French law.
The 1980 United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before any recourse, the Customer, whether consumer or professional, is invited to contact Human And Science’s complaints department in order to seek an amicable solution.
18.2 For Consumer Customers
If no agreement is reached or if the Customer justifies having previously attempted, in writing, to resolve the dispute directly with Human And Science, a voluntary mediation procedure will be proposed, carried out in a spirit of loyalty and good faith with a view to reaching an amicable agreement upon the occurrence of any conflict relating to these T&Cs, including their validity.
To initiate this mediation, the Customer may contact the Human And Science mediator CM2C, whose details are:

The Customer also has the possibility to use the European Online Dispute Resolution platform accessible at: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR
The party wishing to initiate the mediation procedure must first inform the other party by registered letter with acknowledgment of receipt, indicating the elements of the dispute.
As mediation is not mandatory, the Customer or Human And Science may withdraw from the process at any time.
If mediation fails or is not envisaged, the dispute that could have given rise to mediation will be referred to the competent jurisdiction.
18.3 For Professional Customers
For any dispute between Human And Science and a Customer acting in a professional capacity, exclusive jurisdiction is attributed to the competent courts of the Paris Court of Appeal, notwithstanding multiple defendants or a warranty call, unless mandatory provisions provide otherwise.
